Eminent Domain Law/Policy in Texas Essay

The Eminent Domain Law is basically defined as the imposition of the power possessed by the state to appropriate private property and to renovate or reconstruct the property for public use. 1 It varies in different jurisdictions. The land that will be taken due to the eminent domain law is called condemnation proceedings. There is a process in seizing a property. First, the government will try to negotiate with the owner and offer an amount or a thing of equal value to compensate the loss of the property. Second, if the owner opts not to let go of his property, the state would exercise its power by imposing the eminent law and appeal to the court. Third, a hearing would be scheduled and argue with the fact that they have negotiated to purchase the land, and the owner would be casted upon with non-compliance with the government’s request. Lastly, if both sides were not satisfied then they can appeal to the court. 2 This is a vicious cycle that breaches the law of private property and also in some way steps on human rights. Though it is legally and constitutionally correct, there are negative implications attached to the undertakings of this law. Here are evidences which prove that the eminent law is applied. In Texas, a debate sprouted because of the undefined limitations of the eminent domain law. Frank Corte represented the state of San Antonio to justify that eminent law is simply taking of private property and made in accessible and useful for the public. Basically, he is talking of economic development. A counter –argument was fueled by Kyle Janek, who represents Houston, that there should be technical discourses about the amendments of the bill and to specify clearly what is â€Å"public use†. Janek’s claim is that there are always hidden motives with the eminent domain law. Another perspective was introduced when John Whitmire of Houston, said that â€Å"is economic development really the public’s interest? † It was brought about the effects of this law and enumerated some of its negative implications such as threatening of job creation, urban renewal, and state revenue resources. Based on what Whitmire has stimulated, Tommy Williams of The Woodlands claimed that the eminent law only made the other entities or such economically-driven officials to condemn private properties that would serve their purpose well. In the end of the debate, Kyle Janek’s suggestion of further supplying the reasons for condemnation has been implemented. In Texas law, it is stated that the government can seize private property only for economic purposes and especially for public use. Jeff Coyle attacked the eminent law and said â€Å"why would Governor Perry sign a bill with loopholes in it? Coyle thought that the loopholes would best serve the private interest of those who seize properties. In this scenario, Coyle is defending the rights of privately owned properties and its condemnation with the use of the eminent law. He implies that the eminent law has a self-serving bias for the politician who suddenly seizes the property. Eminent law is for economic development but also abstraction since it problematize on how can the people protect their own property though it is for public use. This was from the Texas Senate News and basically claims like the first other debates, the definition of â€Å"what is public use†. Bill Peacock of the Texas Public Policy Foundation stressed that the transfer of a private ownership to one another using the eminent law must be forbidden. Peacock also stressed that the court is too liberal in interpreting what is for public use and not. Basically, the eminent law has not been limited to any private property and all that is said to be needed for public use can be seized by the government. The origin of Peacock’s arguments came from Jenifer Zeigler who is an attorney in the Institute for Justice and claims in her proposed Senate bill 7 that the â€Å"public use† should be clearly defined and all of the transactions and negotiations should be done constitutionally. In the end of it, Attorney Joe Doegey made the closing remarks and defended the government that the eminent law enforcement was critically thought of and that all the properties that have been claimed were all constituted for public use. The committee then decided for adjourning the meeting and the case can be subjected in future meetings to come. This was what transpired in the meeting of the Joint Committee to Study the Power of Eminent Domain in 2005. In defense of the Eminent Law, Michael Allan Wolf, a professor in the University of Richmond which focuses on property law, states that the eminent law is good for the people since it promotes to claim private properties into public use. He had given examples such as railways and assembly lines. In the creation of railways, it made some parts of the state more accessible. Trading and other business transactions were a lot easier. With the birth of the assembly lines, people near the area are most likely of getting employed. With this positive note, he even claimed that the eminent domain is the â€Å"engine of public progress† since the people is making good use of the seized facilities. In summary, there is no clear limitation for the eminent domain law. Even if there many revisions or suggestion to make the law better, the economically-driven politicians will always find a way to exploit this law. Abuse of the law is what occurs in this point. There are no restrictions for the one who holds the power and can claim the properties that he may wish. The eminent domain law is powerful and useful but at the same time, it as like a double-edged sword that the people adhere to. There are act of the government and other institution to revise this law in protection the properties of the public and also to sustain the people’s rights. Much justified, the eminent domain law is being abused by the ones who are in the position. It is up to us the people who should know about the law and better yet our rights. The eminent domain law is made not to seize property irrationally but a condemnation for economic development. It is a law since it is very powerful yet it is just like a policy since it has many loopholes in it.

Crisis in Movies Assignment Essay

1. Identify precipitating event(s). (10 pts.) The movie I chose to watch is Courageous. The precipitating event in this movie is the car accident that takes the life of Emily Mitchell. Her father, Adam Mitchell, and the rest of her family are traumatized by the sudden death of their 9 year old daughter/sister. In thinking about information that would be gained in the first contact with Adam Mitchell, one thing that stands out about his previous state of mind/functioning is that he was somewhat uninvolved with his children, taking them for granted. This fact can also be a trigger for how he processes this event, causing a crisis for him as he realized his young daughter is now gone. In another scene, Emily’s brother, Dylan Mitchell, shares that he feels guilty that he wasn’t a better brother. Both of these relational states prior to Emily’s death can be a precipitating factor in how they process this trauma – influencing whether they get stuck in crisis of guilt, depression over lost time, etc. or whet her they see this as an opportunity for change in the way they handle relationships from now on. 2. Identify the type of crisis (Situational, Developmental, Existential). (10 pts.) This crisis is a situational crisis, in that it is brought about by the sudden death of Emily. However, it can also produce developmental and existential crises in the lives of this family, as they process their loss. A traumatic event is known to potentially create problems in the future development of the individual or family, and it is certainly known to create existential crises, as the individual’s core beliefs about self, others, and the world are extremely challenged during crisis. Beliefs about meaning, purpose, and the existence of God are often questioned after major tragedy. 3. Identify the material, personal, and social resources available to the individual. (10 pts.) The material resources available to this family were that they were a middle class family, with a stable home, and no financial worries that were evident to complicate their loss. The personal resources of the family were that they seemed to be a fairly strong, intact family prior to the crisis. They were clearly a family of great faith in God, and this personal resource literally becomes what carries them through the crisis. As a result of their involvement in church and community, they had the social support of their friends/church members in the early days following the loss. Adam Mitchell also has the ongoing counsel of his pastor, who walks through the process with him, comforting him yet challenging him to grow and not get stuck. 4. What were the differing perceptions of the crisis? (the client, family, community, friends, legal perspectives) (10 pts.) The perspectives within the family are the most obvious. Adam led his family to accept the tragedy as God’s will for their lives and to trust Him with their pain and healing. He seemed to grieve for a while and then dive right in to trying to be a better dad. The mother is shown grieving, and then l ater supporting him as he sought to change his parenting; therefore, her perception seemed to be a fairly healthy one. The brother, Dylan, did not seem to do as well at first. He isolated for a while, but the reason came out one night at the dinner table when he cried, saying he should have been a better brother. The guilt had obviously been causing him to withdraw, but when he finally talked about his real feelings, he is seen making improvements. 5. Briefly, how was the crisis handled by the protagonist? (10 pts.) The protagonist in this movie was Adam Mitchell, the father of Emily who died in the car crash. Adam handled this crisis very well, as it became a catalyst for growth for him. In one session, he is talking with his pastor after a few scenes that have shown him grieving, his wife grieving, and his son beginning to isolate from the family. It is at this time that Adam has a choice in how he handles his opportunity to move forward or stay stuck. He tells his pastor that he does not want to get stuck and bitter, that he wants to heal and he wants his family to heal. It is at this point in the movie that Adam begins to pour himself into studying what God’s word has to say about being a father. After discovering that he was only doing a small portion of what God required of him as a dad, he makes a resolution to change that. Indeed, he does so and brings several other men along with him as well. By choosing to grieve in a healthy way, Adam allowed his crisis to make him a better father and to develop his relationship with his wife and son to a stronger place than it had been even before his daughter’s death. 6. Suggest several steps for your client that could be used to handle the crisis. (10 pts.) Since this crisis did not put Adam, or anyone else in his family, in direct danger, I would take on the role of a facilitator. As a facilitator, I would collaborate with Adam to set some goals for himself. An important thing to remember would be to help him survive and rebuild. This ultimate goal can be accomplished through smaller goals that center on bridging the past, accepting and living with the present, and finding a new path for the future. Practical steps for Adam in processing his loss would be to suggest that he remain connected to his support system, gently guide him to face his pain versus repress it, and have him identify secondary losses and unfinished business due to his daughter’s death. One poignant example of resolving unfinished business in the movie is when Adam goes and pretends to dance with his daughter in the place where he had rejected her invitation a few days before she died. While we can’t always recover secondary losses, we can allow the secondary losses to teach us about how to handle relationships differently in the future. This information can be used in finding a new path. Lastly, if my client was a Christian and I could talk openly about God, I would help to reframe their understanding based on a biblical perception of how God promises to use crises for the good of those who love Him and are called according to His purpose (Romans 8:28). Lastly, considering that this was a sudden and traumatic death, I would likely suggest a grief support group for the family. 7. Suggest steps for teaching coping skills and developing resiliency (preventing the crisis from reoccurring). (10 pts.) It’s hard to keep a death from reoccurring, but a client can be strengthened so that they do not move into active crisis each time they fear a new loss. In the case of sudden death of a loved one, a sense of fear over a new loss can almost cripple a client. I have had personal experience with this myself after losing my son in a drowning accident. Therefore, I would immediately want to help the client frame healthy perceptions about the event so that fear patterns do not get locked into the brain. Therefore, when it comes to re-traumatization after an initial trauma, early intervention is critical. Crisis debriefing can help to prevent trauma loops from being formed in the brain, which would contribute to possible crisis reoccurrence. As far as resiliency is concerned, I would suggest that the client remain connected to social support and remain connected to God. Trusting Him in crisis can help tremendously toward a healthy outcome. 8. What referral sources would be available to the client if he/she lived in your area? (specific names of organizations in your area to which you might refer your client. You might have to research your area for this.) (10 pts.) Grief Share groups at several churches in the area (i.e. Hebron Baptist), Cornerstone Counseling (provides trauma recovery services), Paraclete Counseling Center, Robbie Sherrill, LCC 9. Discuss a Biblical worldview or principal related to the crisis. (10 pts.) Anytime there is a tragedy or loss, one might be tempted to question the goodness of God, or even the reality of God. However, God is in control and never surprised by tragedy. A good principle to remember when God does allow suffering is to trust that God works all things for the good of those who love Him and are called according to His purpose (Romans 8:28). Also, Scripture makes it clear that God uses suffering to refine us. Therefore, processing tragedy by asking â€Å"what can I learn from this† is healthier and more biblical than seeking to know why. God knows the end from the beginning, and even though we may not know why while on earth, we can know the peace that comes from trusting Him to bring good from our suffering.

That way, the scammer can use the login detail to have full access to the victims profile, which then can be used to scam more users and sell their personal detaisl on black market. This shows that social networking is a leading area for scammers to either steal personal details or send spams. Social networking is very common in teenagers or underage users. Most of these teenagers dont take into account or acknowledge the dangers of social networking sites. To them, all the social sites seem innocent. Most of these kids use these sites only to stay in touch with friend. Social networks are a hub for paedophiles and perverts. In the late 19th and early 20th centuries suffrage campaigners succeeded in securing some legal and political rights for women in the UK. By the middle of the 20th century, the emphasis had shifted from suffrage to social and economic equality in the public and private sphere and the women ¡Ã‚ ¦s movement that sprung up during the 1960s began to argue that women were oppressed by patriarchal structures. Equal status for women of all races, classes, sexualities and abilities - in the 21st century these feminist claims for equality are generally accepted as reasonable principles in western society; yet the contradiction between this principle of equality and the demonstrable inequalities between the sexes that still exist exposes the continuing dominance of male privilege and values throughout society (patriarchy). This essay seeks to move beyond the irrepressible evidence for gender inequality and the division of labour. Rather, it poses the question of gender inequality as it manifests itself as an effect of patriarchy drawing from a theoretical body of work which has been developed so recently that it would have been impossible to write this essay thirty years ago. Feminist Theory and Patriarchy Although  ¡Ã‚ §Ã‚ ¡K patriarchy is arguably the oldest example of a forced or exploitative division of social activities ¡Ã‚ ¨ and clearly existed before it was ever examined by sociologists, the features of patriarchy had been accepted as natural (biological) in substance. It was not until feminists in the 1960s began to explore the features and institutions of patriarchy, that the power of the concept to explain women ¡Ã‚ ¦s subordinate position in society was proven (Seidman, 1994) . The feminist engagement with theories of patriarchy criticised pre-existing theoretical positions and their ideological use, tracing theoretical progenitors of popular views about gender, gender roles etc (Cooper, 1995; Raymond, 1980). Developing theories to explain how gender inequalities have their roots in ideologies of gender difference and a hierarchical gender order, feminist theoretical concepts of patriarchy are able to explain and challenge gender inequality and the gendered division of labour in the private and social spheres (Seidman, 1994).

Introduction Since I was a child the idea of being a business owner has been a dream of mine. I never knew the requirements of starting, running or growing a business; however, I knew I needed to design a product to sell. In the 6th grade I approached my parents and told them when I grow up I want to own a business. I vividly remember my Father laughing while my Mother smiled and told me that it took a lot of work, time and experience to own and run a business. Terabytes or 1000000000000 (a trillion) bytes of Mp3 files can be found online at peak times, which roughly translates to 330,000 songs in 3100 different collections. A Mp3 is an individual song converted into a digital format and playable on computers.   Ã‚  Ã‚  Ã‚  Ã‚  A popular program easily accessible on the Internet is called Napster. After you download it from Napster’s site, you basically tell it where you keep your Mp3 files and when it connects it cross-references everyone’s files and lets you search through them all and download as you please. 90% of the files that are traded daily are illegally â€Å"ripped† from CDs. Napster has a blurb at startup that states â€Å"Copying or distributing unauthorized Mp3 files may violate United States and/or foreign copyright laws. Compliance with copyright law remains your responsibility.† The RIAA (Recording Industry Association of America) is charging the site with copyright infringement and alleges that Napster has created a base for music piracy on an unprecedented scale. Napster contends that they provide the platform, not the actions, and that as the blurb states it’s up to the people. Napster is not at fault because the RIAA has overstepped their boundaries and infringed on first amendment rights online.   Ã‚  Ã‚  Ã‚  Ã‚  Should the owner of the gun shop be charged with murder if a man he sold a gun to decides to shoot another man in cold blood? Of course not, if the shop owner followed all of the laws that govern him. Should the car dealership be charged with vehicular felonies every time one of their vehicles is involved in a crime? Certainly not. So why should software’s originator be responsible for what their software is used for? They shouldn’t, but the only reason the RIAA is jumping all over the Napster community is that they can’t just go out and arrest everybody who decides to trade Mp3s online.   Ã‚  Ã‚  Ã‚  Ã‚  The real people that the RIAA should crack down on are the people who use the rippers. A ripper is a computer program used to convert (rip) a musical track off of a CD and into a Mp3. They can be found on public shareware sites fairly simply with a search engine. The problem here is that the public in general uses them and can download them just like any other software.

Evaluate the assessments you have carried out, stating whether you believe they were fair, valid and reliable. During the Skype assessments I carried out on 2 learners, who are studying the nvq level 2 in customer services. My job was to observe the 2 learners and assess their ability, and then match against the criteria set for the units which I was observing them for. For both of my learners there are a number of assessment methods I have tried, in order to understand their learning ability. From doing these assessments I have understood where my weaknesses, strengths are, along with the learners. Personal Statement I started off by asking them to write in their own words, how do you maintain a positive and customer friendly attitude, and how you communicate effectively with customers? By them completing these personal statements, it gives me an understanding that they know what their job role is. As these two points which they have written about in their words, are the two units. Basically what I have asked them to do is sum up in their own words what they have understood from the units. I believe that by assessing learners through this method, it is a fair, valid, and reliable. This is because I know the learners, and the information which they have written about is valid because it is in their own words, from their own understanding. However there may also by the disadvantage of doing a personal statement. This is because I believe that there may be a possibility that a personal statement could be written by someone else, as there is no validity and proof of this being created by the learner him/herself. However I have followed these personal statements with questions which brought me to the conclusion, that my learner’s personal statement is valid, fair and reliable. Observation I also used the observation method to assess my learners. I asked my learners to carry out tasks which they have to do, in conjunction with their daily work routine. I observed my learners as they made calls externally and internally, which showed me how good their communications skills are. They called customers and discussed issues which they were having, whilst I was observing their quality of assistance. I believe that this method is fair, valid and reliable, because I can see, hear and also take notes whilst they are carrying out the tasks. From my experience I think that this method of assessment is very good as it gives the assessor a wider choice of observing. But at the same time I would say that it also is not so good, as the results may not be correct. Sometimes the learners may not respond accurately, as they may feel embarrassed, they may not feel too well, and there are other various reasons. Oral questions At the end of the assessment, and also during the assessment, I stopped my learners and asked various questions. Sometimes I asked questions relating to what they were speaking of, for example, one of my learners was talking about CRM, and I had no idea regarding this. So I asked her to explain about it. In a similar way I asked them questions relating to the course. I think the assessments are fair, valid and reliable as they are put on the spot, and answering these questions shows their understanding and capability of the course. Written Questions/Case Study As part of the assessment, I sent a couple of questions which they had to answer in a time limit of 20 minutes. These questions were to determine their skills around the course and their practicality of work. I selected these questions from the criteria of the units which I was assessing them on. These questions are knowledge based, which means that they had to answer in detail, explaining their views and choices. In a same way I set a case study for the learners, where I gave them a scenario, and at the end asked them questions regarding the scenario. Whatever the answers were, the learners had to explain why they chose this answers. I believe this method of assessment is fair, valid and reliable, this is because the learners must write answers from their own understanding of the unit. But along with this, many times learners get the feeling to cheat. However I have carried out some questions which made me believe that the answers were valid. Discuss whether the assessments went well and what would you do differently next time I believe that the overall assessment itself went well, as I came to conclusion after carrying out each method of assessment. I asked my learners to do a personal statement, writing in their own words relating to the unit. Although this is a good way to get an understand of the learners ability, I strongly feel that rather, I should ask them the question, and they answer me, which I could then write down. I believe both observations are really good method of assessing the learner, as i just watched and noted what they were doing, and didn’t need to interfere with their task. But I believe that a Skype method may not be so well, as I felt the learner may not have been so comfortable with this. This is because I could see her, where as she could not see what I was doing. This then becomes a barrier to both sides communicating effectively. So I think that next time when an assessment takes place, both sides should be able to see what both sides are doing. I don’t think my oral questions were so good, I believe they were straight forward and easy to answer. This is because I had less time to prepare the actual assessment itself. And I believe that if I had more time then I could have constructed these questions more complex, which then could be more challenging for the learners. I think that next time I plan for these methods of assessments, I should create a good series of questions, which could give me a better understanding of the learner’s knowledge. As for the written question and the case study, although I believe they are strong methods of assessment, as they allow the assessor to evaluate the learner’s knowledge. I also think that sometimes learners may take advantage of being distant and cheat. I believe that these methods of assessments should be carried out whilst the assessor is watching via Skype. Identify any learning points for your own development. From the feedback received from my tutor, I believe there are two main points which need to be developed before the next assessment, as they relate directly to assessments. The first learning and development point that I need to work towards is the grammar and spelling of my work. I need to make sure that all my work is proof read before sending of for marking. Although this has been my weakness, and I have been advised to always keep this in mind. I believe that this happens due to me rushing through everything. So I believe that if take everything one step at a time, it could reduce the grammatical errors. I could also reduce this by always proofreading work, which would highlight the errors. On a development note which has come to me newly, is the selection of words. I have been told by my tutor that the feedback you gave included the term ‘sweet’ to describe the communication of one of the candidates. My tutor advised me that I must be on the safe side and avoid these terms, as they are deemed offensive. I believe that this is true and I could work towards improving this, where next time I should think of the words I select before giving feedback. Explain how you will continue your professional development to ensure current expertise and competence in your own vocational area as well as assessing. I will use my CPD plan in order to ensure that my current expertise and new experiences are brought to real practice. Every time my tutor, or my colleagues who monitors my every lesson gives me feedback on what I can improve, I put that in my personal development plan. I then try and implement those, and once I have achieved this I tick on the plan. For example, I have been informed more than twice by my colleagues to always go back to lesson objective whilst teaching. I also have been informed by my tutor about my grammar and proof reading my work. So I have created a note on my plan, and now that I have put this action into practice I have ticked off this note. Now until I bring proofreading fully into practice, i will not tick this off. I will be using my CPD plan to note any improvements which I need to make, and then as an outcome assess if that objective has been met. I will continue to practice until this objective has been met, and once it has I will tick this objective off. By following this CPD plan, it will enhance me in my expertise and advance my skills.

Operations Management: Quadruples Restaurant Case Essay

Can these kinds of customer response data be obtained reliably, systematically, and cheaply enough for a restaurant? If so, how? This type of data could be gotten by adding survey questions to a receipt given to a customer with a few questions relating to the Pareto chart (Ex B). This can also be done by observation of host (ess) when times are not busy noting customers body language. Also managers can go around to tables and ask how their meal was, and if anything was unsatisfactory. The important thing is to have a log of this data, which can be analyzed, at the end of each week and solutions implemented at the beginning of each week to try and resolve problems quickly as they develop. One type of bias the restaurant may have to worry about is the concept of â€Å"self-selection†, where a person who has a bad experience is more likely to voice their opinion than one who has not. Another great example of how this data can be obtained is through benchmarking and competitive analysis, looking at how other competitors deal with their problems and applying the best solution to a given case. Benchmarking can easily help provide better service to customers by applying the â€Å"best practices† found in leading restaurants. Which of the Exhibit B complaints are natural targets for continuous improvement in the restaurant (or any enlightened firm), thus, perhaps, not requiring solicitation of customer inputs to reveal the target for problem solving? The of course obvious and most logical answer would be all elements could be improved upon. As we’ve discussed in class, â€Å"if you aren’t improving your product/service your loosing ground.† However I choose ones that could immediately be implemented through better training of the servers/busboys. In referencing the Pareto Chart of Complaints: Room too drafty, Table not clean, Buffet table not well organized, Missing utensil at place setting, no ashtray on table, and had to wait too long for coffee could all be elements of continuous improvement. An example of how a problem could be solved is  (G), simply setting up a smoking section where ashtrays are a mainstay at the table, if this cannot be implemented simply having the host(ess) after asking smoking/non bring a ashtray to the table, or after determining the size of the party have the host (ess) gather the utensils (the basket under the greeting table) before showing them to their table. The one I said could not be immediately improved upon is the room being too drafty, this may require a more physical solution such as adding another set of doors to the entrance thus alleviating draft cause through the entranceway. The solutions can be developed through training the staff, (i.e. busboys, servers, host (ess)) to have a mental checklist of what needs to go on a table before it is ready to be sat, and having the host (ess) make sure they are seating people in the appropriate section (i.e. enough utensils, ashtrays, etc). All of the complaints in Exhibit B clearly are things customers would notice. If restaurant staff, instead of customers, were asked to express their complaints, suggest at least five complaints that would probably come forth. To what extent could the staff’s mind-set be altered so that they would worry about the same things as customers? How could this change occur? 1) Angry/disgruntled customers – low tips, not due to service 2) Too many tables designated at a time for one person 3) Too many hours – better scheduling 4) Managers who don’t consider the individual – not concerned about your problems 5) Kitchen not staffed adequately during peak times – customers are angry and take it out on servers A way of getting staff’s mindset to change is remind them of all their bad experiences in restaurants, getting the staff to own the problem. This can  be done in a monthly training sessions where customer complaints are voiced to all the staff showing them that there is a problem. Even showing how better service can mean more money to them is a high motivator. Show that you are going to make changes to better both the customer and the staff to make the workplace an environment where information is freely shared and solutions can be brought â€Å"in house† before going for outside the restaurant (i.e. corporate). Most importantly market each improvement, boast to your staff about how quickly problems are resolved, make your restaurant the one others are trying to benchmark for your best practices.

Michelle Bachelet

Michelle Bachelet (Veronica Michelle Bachelet Jeria) is a current Executive President of the Republic of Chile, a Pacific coastal country in Southern America. Bachelet was nominated in 2004 as a left-centrist candidate for presidency and won the election runoff in January 2006 gaining 53.5% of the votes and becoming the first female President of the country. Moreover, she is the first Chilean female political personality of high importance who established her political career and managed to advance in politics using no help and connections of her husband or male protectionist.Bachelet was born on September 29, 1951, in Santiago, to a family of Chilean Air Force Brigade General Alberto Bachelet. Her childhood was one of constant traveling from one military camp to another, and her first interests included volleyball, theater and music. After finishing high school in 1970, she entered a medical college of the University of Chile with one of the best national enrollment test result. Fro m he own words, she decided to dedicate her life to medicine because it was â€Å"†¦a concrete way of helping people cope with pain..† and â€Å"..a way to contribute to improve health in Chile† (The Andean World, n.d.).In 1973, when Augusto Pinochet seized the reins of power, Alberto Bachelet was arrested and charged for treason. After several months of torture he died of a stroke. This tragedy was followed by arrest and deportation of Michelle and her mother, so they spent several years in Australia and East Germany, where Bachelet continued her education and worked in a communal clinic. In 1979 the Bachelets received permission to be back to Chile, where three years later Michelle received an M.D. and continued her social activities as a member of Chilean Socialist Party, promoting the ideals of democracy and social equality.Her political career started in the mid-1990s when she entered the ballot for the Head of Las Condes Administration. In 2000 Bachelet was appointed Minister of Health as a person with high competence in military medicine and a good experience of work in such organizations as the National AIDS Commission and the National Health Service. Her liberal reforms did not receive a lot of support from the Ministry officials. That is why Bachelet attempted a resignation which was, however, rejected by the President. Soon, she became a Minister of Defense, the only female in the continent to hold this administrative position.Her presidential campaign started in October 2004 and she had to face a former Senator and member of Chilean center-right party Sebastian Pinera as the main rival. In the first round Bachelet could not obtain the majority of the votes, receiving only 46%. Nevertheless, the runoff against Pinera proved to be more successful, and in March 2006 Michelle Bachelet entered the office as the first female President of Chile, bringing along many new politicians (including a lot of women) as the members of her Cabinet .The first year of her presidency was marked by a number of determined political steps, liberal democratic reformations and scandalous dismissals of some of her Ministers. In particular, she had to fight with very deep-rooted corruption which was spread throughout the country’s administration system. Besides, Bachelet’s recent decree allowing selling â€Å"morning after pill† over the counter to the girls over 14 evoked a wave of national criticism and disagreement. Currently, she is facing another problem: the necessity to improve Chilean transportation system according to the project called Transantiago.Nevertheless, she tries to keep her popularity high by organizing and participating in numerous governmental health care programs. In addition, Bachelet is a very active player in foreign politics and her major accomplishments are a number of treaties with developed Asian countries, establishing the Trans-Pacific Strategic Economic Partnership. Her main persona l values are duty and responsibility. Last year Forbes ranked Michelle Bachelet as the 17th of the world’s 100 most successful women, and her reaction on this recognition of her efforts was the following: â€Å"This is not a ranking that motivates me. Causes of Parallel Economy in India Essay

There are several factors responsible for the emergence – of parallel economy. It would be relevant to discuss those factors so that a correct understanding about the genesis, growth and expansion of black money can be made. The principal factors are: 1.Rigid and Complicated tax & high tax rates implemented by the government- High tax rates and defective tax structure have also been responsible for the existence of black money to a large extent. Take for instance direct taxation. Till recently the tax on income and on wealth was very high to invite evasion. The marginal rate of income tax was as high as 75 per cent. And when it was combined with the tax on wealth, it was still higher. The corporate tax rate too was very high. In these circumstances the temptation / gain from tax evasion was substantial. 2.Quantitative and qualitative Controls and licensing system- The system of controls, permits, quotas and licenses which are associated with misdistributions of the commodities in short supply results in the generation of black money. Since considerable discretionary powers lay in the hands of those who administered controls. This provided them with a scope for corruption – ‘speed money’ for turning a blind eye to the violation of controls. All this gave rise to trading in permits, quotas and licenses, malpractices in distribution and in the process; it generated sizeable sums of black money. 3.Price and distribution controls- Price and distribution controls have in the past led to the generation of black money on a significant scale. Any price control without any adequate machinery of distribution and speedy arrangement for increasing supplies is potentially a source of black money generation. 4.Hawala market as the main cause of black money generation- It is very well known that the international smugglers or the traders in other illicit trade cannot complete their monetary transactions through any nationalized or other private legal banks in India. Also, the amount of money in which the drugs and other weapons are imported or exported is quite large, usually in billions. 5.Transactions is real estate property- Since the sale of property on lease hold is permitted by the government only at a payment of certain amount of premium to it, the lessee generally completes this transaction through the power of attorney so that they escape from paying the premium which is fixed on the basis of the difference between the current market price and the price fixed by the government. 6.Inflation – Both a Cause and Consequence of Black Money- During inflation there is a general rise in the consumer price index or simply the cost of living of the people. As such, the workers and the various labors in the production process demand a rise in their wages to meet the rise in expenditure. This lead to increase in the cost of production of the products. They try to meet this increased cost of production by increasing the profits margin through sales price. 7.Deterioration of the Quality and Morality of the General Masses- The objective of the business is generally profit maximization and that of government is social justice and quality that goes against each other. But it seems that both have joined hands to maximize their own profits at the stake of the common people. Bribing the government officials and letting them earn some commissions on the foreign export and import by urging them to reduce the customs duties and simplify the procedure of documentation are some of the common phenomenon in our daily life. 8.Donation to Political Parties- Ever since the Government decided to ban donations to political parties in 1968; it prompted businessmen to fund political parties, especially the ruling party, with the help of black money. Ostensibly, this decision was taken to reduce the influence of big business on the electoral process, but in practice what happened was precisely the opposite. Businessmen everywhere have by now learnt that they should pay a certain charge out of the black money to the coffers of political parties, resulting, relaxation of various controls, permitting business houses to enter areas reserved for the public sector, putting a large number of banned items on the Open General License list etc. 9.The Political Instability Witnessed in the Country- In various states widespread horse-trading of the MLAs at the state levels and MPs at the Central level. In this process of buying political support, black money plays a crucial role. Consequently the determination of the ruling political party to curb black money has become very weak. As a consequence, businessmen feel they have an unfettered license to spin black money, pay a small part to the political parties as donations and then enjoy the rest the way they like. Unless the link between black money and political power is broken, there is no hope of controlling the generation of black money or its link with crime. 10.Ineffective Enforcement of Tax Laws- Whereas the Government has an armory of tax laws pertaining to income tax, sales tax, stamp duties, excise duty etc., their enforcement is very weak due to widespread corruption in these departments. . The high rates of these taxes induce businessmen to avoid recording of these transactions. This evasion largely goes unchecked and thus sets in a chain reaction for the generation of black money at the wholesale, retail as well as production levels. 11.Generation of Black Money in the Public Sector- Every successive five-year plan is planned for a larger size of investment in the public sector. The projects undertaken by the public sector have to be monitored by the bureaucrats in Government departments and public sector undertakings. Tenders are invited for the various works and these tenders are awarded by the bureaucracy in consultation with the political bosses. 12.A Symbiotic Relationship Develops between the Contractors, Bureaucracy and the Politicians- A symbiotic relationship develops between the contractors, bureaucracy and the politicians and by a large number of devices costs ‘are artificially escalated and black money is generated by underhand deals. Instability of the political system has given a further momentum to this process. Since the ministers are not sure of their tenure and in a majority of cases, the tenure is very short, the principle ‘Make hey while the sun shines’ is adopted by most of them. The larger numbers of scandals that are unearthed by the Opposition only support the contention that huge investment in the public sector is a big potential source for black money generation. In this process, bureaucrats act as brokers for political leaders and thus the nexus between business, bureaucracy and politicians promotes the generation of black money. 13.Ceiling on Depreciation and Other Business Expenses- Government has imposed restriction. It has also circumscribed expenses on advertisement, entertainment, guest houses, and payment of perquisites to directors. The purpose of these restrictions is to protect the shareholders and consumers from the unscrupulous action of businessmen. But businessmen feel that these restrictions are unjustified. They take the maximum advantage of these provisions but do not like to part with the remaining part of by various clandestine devices; they convert it into black money and use it either for conspicuous production to satisfy the wants of the rich and elite sections of society. 14.Capitation Fees- Capitation fees are a very common term used in the context of admissions in big educational institutes and universities. Capitation fees if another term used for the donations given to these universities for the purpose of seeking admissions when the students fails to secure the minimum cut off percentage required. Generally, the money rose by these colleges and institutes through these methods are not revealed to the income tax departments. They are also called the hidden income of these educational temples. Moreover, the amount of capitation fees for big in Small Scale institutes ranges in lakh and not just in thousands. 15.Unawareness of the Consumers’ Rights and Duties- Unawareness of the consumer’s rights and duties is also another cause for the generation of black money. For example, the consumers fail to take a proper invoice from the shopkeepers so as to evade the tax to be paid on the purchase of those goods. There are more of such instances where the shopkeeper too fools the consumers. Sometimes, they charge more that mentioned as MRP on the packet. They even paste false stickers on the packets to hide the real value of the good. The extra money charged above the MRP is kept by them as black money. They do not pay taxes in such income. 16.Donations to Charitable and Temple’s Trusts- Donations to charitable and temples trusts are another source of black income. There are various issues related to the income of these trusts.
